Terms of Service

1. Acceptance of Terms

By accessing or using the Omavant platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is intended for use by authorized personnel of Independent Medical Examination (IME) vendor organizations and their DDS scheduling partners.

2. HIPAA Business Associate Agreement

Organizations using the Service to process Protected Health Information (PHI) must execute a HIPAA Business Associate Agreement (BAA) with Omavant prior to entering any PHI into the platform. Use of the platform constitutes acknowledgment that PHI will be processed in accordance with HIPAA regulations.

3. User Accounts and Responsibilities

  • Users must maintain the confidentiality of their login credentials
  • Users must not share accounts or allow unauthorized access
  • Users must report suspected security incidents immediately
  • Organization administrators are responsible for managing user access and permissions within their organization

4. Acceptable Use

The Service may only be used for its intended purpose: scheduling CE appointments, managing clinical evaluations, generating reports, and related administrative functions. Users may not use the Service to store or transmit information unrelated to CE evaluations, or to circumvent security controls.

5. Data Retention and Ownership

Clinical data entered into the platform remains the property of the organization. Omavant acts as a data processor (Business Associate) under HIPAA. Organizations may request data export at any time. Upon termination, data will be retained per applicable regulations and then securely destroyed.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for delays or interruptions caused by circumstances beyond our reasonable control.

7. Limitation of Liability

Omavant provides tools for clinical documentation but does not provide medical advice. All clinical decisions, diagnoses, and treatment recommendations are the sole responsibility of the licensed provider. Omavant is not liable for clinical outcomes resulting from use of the platform.
